Terms & Conditions

Every person intending to hire goods from Zesti Studios must read and agree to the following Terms & Conditions before proceeding.

By accepting the quote & paying the hire deposit you are accepting of the below terms & conditions.

1. This document records the hire Terms & Conditions of which you (the Participant) agree to hire of picnic equipment, use of picnic equipment & any related equipment (ie. Outdoor games, craft equipment) owned by Zesti Studios.

2. Zesti Studios may in its own discretion and without having to show cause; refuse to hire picnic equipment to a customer, cancel a booking, require the early return of picnic equipment & or exclude a Participant where a participant does not comply with this agreement.

3. Zesti Studios will provide confirmation to the customer where it accepts a customers request to hire a Picnic. Where a booking request is not confirmed, Zesti Studios is under no obligation to hire a picnic to the customer. Zesti Studios makes no guarantee or warranty as to the availability of a Picnic where a confirmed booking has not been made.

4. A deposit of 30% is required to secure a Zesti Studios Pop up Picnics/ Event Hire package. Deposits should be made by the hirer on or before the due date as stated on the invoice provided.

5. Zesti Studios will ensure that a Picnic set up is clean & in good working order as at the start of the hire period.

6. Risks associated with a Picnic always lies with the Customer from the commencement until the end of the hire period.

7. The customer must;

   1. Satisfy itself at the commencement of the hire period, that the picnic is suitable for its purpose.

   2. Arrive at the scheduled booking time.

   3. Ensure that all participants are suitably instructed on the safe and proper use of the Picnic.

   4. Immediately report and provide full details to Zesti Studios as soon as any accident or damage occurs in respect of the picnic hire.

   5. Return the Picnic at the end of the hiring period in a tidy and hygienic state. In the event a Picnic is not returned in a tidy & in working order and on time, Zesti Studios may charge, and the customer must pay the additional hire chargers for all cleaning, repairs and general costs incurred by Zesti Studios.

8. Each participant at all times during the activities must;

   1. Indemnify Zesti Studios for any losses, damages, claims, injuries, liabilities, costs, chargers, or expenses to the picnic, any persons and any third-party property caused or contributed to by any participant.

   2. Take all due care when using the picnic equipment and not cause any loss or damage to the picnic, injury to any person or any loss or damage to any other equipment.

   3. Use the picnic equipment safely and strictly in accordance with the laws of the state or territory in which the picnic is hired, only for its intended use and in accordance with any instructions provided by Zesti Studios.

9. Safely secure all items bought to the picnic or in the possession of any participant and indemnify Zesti Studios in respect of any loss, injury and/ or damage of items in the possession of any participant.

10. Acknowledge that any loss or damage to personal property is the sole responsibility of the participants and Zesti Studios accepts no liability for any such loss or damage to personal property.

11. Declare any food intolerances or allergies to Zesti Studios, where catering is supplied.

12. The hirer is to ensure adequate safety measures are adopted when using hire items provided by Zesti Studios when necessary.

13. The hirer agrees;

•  Not to move hire items once they have been assembled at the venue or location.

• That if items are used incorrectly, they are used at the hirer’s own risk.

• It is the responsibility of the participants to inspect the venue or location to be sure it meets necessary safety standards for guests.

• Any storm warning or natural disaster warnings will result in rescheduling or moving the picnic to an indoor or undercover area at the client’s discretion.
